DESCRIPTION:
This directive instructs member states of the European Union to decide which of their government authorities will take responsibility for carbon dioxide stored in injection sites after injection ceases. It also directs that ownership and liability of stored CO2 should transfer to the member states no less than 20 years after the closure of the injection site. This directive applies to storage sites which are intended to hold more than 100 kilotons.

A directive is a legislative act of the European Union (determined jointly by the Parliament and the Council), which requires member states to achieve a particular result without dictating the means of achieving that result. This directive states that all operating injection sites should be in compliance with this directive by June 25, 2012.
EXPERIENCE: Guidance documents are expected to be published by the end of 2010 and several member states aim to transpose the directive into domestic law by the end of 2010.
